Sunil_Bh Posted April 30, 2011 Report Share Posted April 30, 2011 Hi, after getting my MS (USA) degree (in F1) I got a job at Company "A" and got H1B starting in Oct 2005. After 2 and 1/2 yrs on H1B, I changed my status to F1 (PhD program). I never left USA since then. Now I am thinking to go back to H1B. I understand that I still have 3 and 1/2 years left from my previous H1B and my 6 years since my first H1B will end this Sept 2011. So I have two ques for different situations: 1) If I get a job at Company "B" and they file for my H1B before Oct 2011, will I be subject to H1B quota? 2) How about if I don't get a job before Oct 2011, do I need to wait until next year to apply for H1B in April 2012, go through H1B cap and start job in Oct 2012? pontevecchio Posted April 30, 2011 Report Share Posted April 30, 2011 In order to get 6 years you have to leave for 1 year and have your sponsor apply after that SUBJECT TO CAP. If you want the remainder 3.5 years that is not subject to cap and you can start on approval. Link to comment
