Pkaruparthi Posted December 20, 2019 Report Share Posted December 20, 2019 (edited) Hello, MY H1-B visa got denied on November 4th and applied for MTR and still waiting on decision. In the mean time applied for H4 dependent visa in the USA and got my biometrics based on my wife H1 B visa. The receipt date for H4 is on November 29th and I contacted two lawyers from my Wife company and they mentioned that I could stay in the USA as long as my H4 is in process after my H1-B denied. MY F1-status got expired on sept 30th which leaves my I-94 as expired. Please advise me if it I come under unlawful presence or not as I have heard good reviews about your firm and trust your advise Edited December 20, 2019 by Pkaruparthi Quote Link to comment
User099 Posted December 23, 2019 Report Share Posted December 23, 2019 If you want to talk to a real attorney, you might have to call the Murthy Law firm office directly. I am not an attorney, but I feel you are ok to stay as you have MTR and H4 pending. If H4 is approved, it might not come back with an i94. Quote Link to comment
