H4VisaHelp Posted December 19, 2019 Report Share Posted December 19, 2019 I am on H1B visa with current H1B valid till Oct-2020(I140 was approved with a priority date of May-2011). I was let go from my current job on 15-Nov-2019, but my PTOs were pending and HR agreed to keep me on Payroll till my PTOs were exhausted, my final paycheck was generated on 10-Dec(including the severance pay) and 10-Dec is the date employer is putting on the H1B revocation letter they will send to USCIS. Based on the 60-day grace period rule, what is my timeline to find a new employer in US? Is it 14-Jan(60 days from 15-Nov) or 8-Feb(60 days from 10-Dec)? Please advise Quote Link to comment
User099 Posted December 19, 2019 Report Share Posted December 19, 2019 Its generally the day you lost your job from which your 60 grace period starts. In your case I feel it will be Dec 10th and 60 days from Dec 10th will be 8th Feb. So by Feb 8th you should file a transfer petition. Quote Link to comment
