Dormant
Hi I was working in H4-EAD, applied for extension, it took lot of time and i have to stop working. Meanwhile my employer applied for H1B in premium (non profit) and got it approved. After 10 days my H4 got approved as well. H4-EAD is still in processing status. Now my lawyer is saying that i have to stop working and go out of the country to get my H1B visa stamped in my passport. I checked the wait times in Canada and India, the minimum wait time in India is 45 days. I have two questions: Can i continue to work? Is there a way to find my current status with USCIS to check if i am in H4 or H1B in their records. Quote Link to comment
User099
As per the last action rule, you are on H4 and without your EAD you can't work. Going for stamping as you attorney suggest is the best option. Quote Link to comment

The latest approved status is the valid one. Quote Link to comment
