H1B NON CAP to CAP TRANSFER

Hello - 

I am currently working for a NON-CAP H1B company ( Non -Profit). I previously held a CAP-H1B ( worked for a profit company). What are the challenges when I want to go back to a profit company ? Would that involve the Profit company filing a transfer or doing a new petition ?

New for-profit company will have to do a Transfer and no special challenges due to you switching from non-profit to profit company. All the usual H1 transfer challenges will apply.

A transfer IS a new petition.

The employer can just file a new H1 petition at any time. Once you are counted in the quota you can change between any employer.

This will new H1B petition outside the quota since you are already counted in quota from your below statement
