Hi,
I was on my OPT till 2017 Oct and since then was on H1B as FTE for local company.
Now I changed my employer in July 2019 and that is a EC model.
I wanted to go to India last year but couldnt go while was FTE in previous company. I asked my consultancy about if there would be any issues in stamping, they said to me only go if its very important or urgent as other are still awaiting to come back under 221g.

I am bit scared now as consultancy is not properly responding to the questions and not explaining me clearly for previous interviews of employees. On the other side, Client extends the date every 3 months for contract and I made sure my project is now extended till September 2020. I have Full time employment of Consultancy but all I am confused is, shall I go to stamping or wait for getting a Full Time role and then go. I have client letter with me already which states that there is no end date for this assignment, it will be valid till my H1B validity. Do I need another updated client letter for my Visa interview as the one I have is during H1B petition for USCIS.

My I797 A is till June 2022.

My background is perfectly clear, I did my MS from reputed University as well but I am worried if there would be issue here seeing 221g for contract roles in returning.

I know I shall have gone last year while I was FTE of local US company to avoid all this but unfortunately couldn't go. These Staffing Consultancies based in US are those blacklisted there in US consulate or its pure Client Relationship with employee to be proved for getting approval.

My Client is based in San Diego, Consultancy is based in Virginia and Client has given me onsite location to work in Texas, this is also the situation here. My LCA states all this clearly.

I have all documents with me but is it safe to go with consultancy and client situation for 1st time H1B Visa Stamping after OPT?

Regarding urgency, it's a family marriage function. Shall I just go without any double thoughts or just again wait for full time?

It will be great if someone can guide me and help here.

Thanks.

No one can advice you on weather to go for stamping or not, it will be your personal decision. You have a good job, all documents and have been working legally, then there is nothing for you to fear. Nothing wrong in working for a staffing company, but if you have that doubt in your mind then better search for a job at a direct client.

If you decide to go for stamping and have doubts on how to answer few questions or if you want some legal advice then talk to an attorney and  have them review you case.

Visas, Transfers, extensions will always be there, but important family functions are once in a lifetime opportunity.

If it is not an emergency situation, better get a full time job and then travel outside the country. Getting 221G chances will be minimized if you are a full time employee.
