yodha2020 Posted December 9, 2019 Report Share Posted December 9, 2019 Hi I work for an IT MNC. I was working on H1B Visa at US client location from June 2015 to Sep 2017. In April 2017, I applied for H1B Extension, then I got RFE in Aug 2017 which I responded but had to come back to India in Sep 2017, then USCIS Denied the H1B Extension in April 2018 due to Specialty Occupation. I applied for H1B Cap Exempt in June 2019, then I got RFE in Sep 2019 for BRM letter which I responded in Aug 2019 and then again got RFE in Nov 2019 for multiple documents. I have all the documents except SOW expiring soon. My query is, I am requested to provide valid SOW with future dates, but my current SOW is expiring in Feb 2020. Can I provide MSA which is valid till June 2022, instead of providing SOW expiring in Feb 2020? Will there be any risk of denial OR only short term H1B approval, if I share SOW expiring in Feb 2020 ? If I don't share SOW and just share MSA, will there be any chance of denial due to lack of information ? Please advise. Quote Link to comment
User099 Posted December 17, 2019 Report Share Posted December 17, 2019 Its best to provide all the documents when issues an RFE, we don't know how they will respond when they see a missing document. You have time to respond to the RFE issued in Nov 2019, can you try for an extended SOW by then. If you submit SOW till Feb 2020, most likely the case will be approved till Feb 2020.
