Laid off - H1 valid till 2-20, Approved I-140 with PD in 6-2011.

I have H1B from the current employer, which is due for extension in Feb-2020,

I have an approved I-140 in EB3 with Priority Date June-2011.

Our department was laid-off today and I have 60 days time from 9-Jan to find my next employer.

My spouse is on H1 and has a approved EB2 I-140 with Priority date Feb-2011.

While I will be starting for my next job hunt, I'm thinking about the steps I need to take to keep my status.

Experts - Please advice on what options do I have here, what is the best one to go for.

If you were laid-off today, your 60 day will start from today and not Jan 9th.

While you hunt for a new job, to be safe I will advice to put in a I-539 (COS to H4) in case your job hunt takes longer than 60 days. You qualify for a H4-EAD, you might want to think about using it rather than going back to H1.

Best to apply H4 EAD and get it approved. Later you can move to H1B if you want.
