jgowris Posted December 9, 2019 Report Share Posted December 9, 2019 I have H1B from the current employer, which is due for extension in Feb-2020, I have an approved I-140 in EB3 with Priority Date June-2011. Our department was laid-off today and I have 60 days time from 9-Jan to find my next employer. My spouse is on H1 and has a approved EB2 I-140 with Priority date Feb-2011. While I will be starting for my next job hunt, I'm thinking about the steps I need to take to keep my status. Experts - Please advice on what options do I have here, what is the best one to go for. If you were laid-off today, your 60 day will start from today and not Jan 9th. While you hunt for a new job, to be safe I will advice to put in a I-539 (COS to H4) in case your job hunt takes longer than 60 days. You qualify for a H4-EAD, you might want to think about using it rather than going back to H1. Quote Link to comment
