Tricky7
Hi, My non-profit employer is filing a cap-exempt H1 B application that won't go through the lottery system. I would like to know the pros and cons of it. I knew that I can't move to any tech companies or profit purpose organizations. If I get a non-profit H1B and if my I-140 gets approved eventually, can I move or transfer to a different profit organization or a tech company? How long it would take (approximately) to get a green card for a mid-level tech position if I go through a non-profit employer? Being on non-profit H1B status, what are the limitations or possibilities of queries or rejection chances if I apply for a lottery-based H1B with a profit-based employer/organization? Any assistance would be appreciated!! Thanks Quote Link to comment
JoeF
You could only move to a for-profit company if you have been counted in the quota. That applies after an approved I-140 as well. There is no change in approval or rejection chances in the quota if you have a cap-exempt H1 or not. The merits of the job offer matters.
