premdice Posted December 5, 2019 Report Share Posted December 5, 2019 Hi I was year 2005 to 2009 h1b eb2 after that its not extended because 6 year limit over and i-140,485 denied. Now after 2009 i am on H4 i didnt go out of country to stay. So now if i want to apply again h1b eb2 can it possible? without leave country ? Prem Quote Link to comment
JoeF Posted December 6, 2019 Report Share Posted December 6, 2019 (edited) To get a new H1 you absolutely have to be outside the US for at least a year before a new H1 can be FILED. So, if you leave before April 2020, and stay abroad for a year, an employer can file an H1 in the quota for you in April 2021, for a start date of Oct. 2021.
