H4 Issue

Hi,

I only applied for H4 EAD without H4 extension and in the meantime RFE was issued for H4 EAD. I realized this after I94 got expired in the last week of Sep 2019. Now, I am travelling to India to attend H4 visa interview and  get visa stamped. My spouse H1B got approved for 3 years until Sep 2022.

Could you please suggest the required documents, questions asked and let me know for any issues related to the visa interview?

Also will there be any issue at the immigration while entering to US once the visa is approved?

Apart from the usual questions, they will ask you why did you overstay your visa. Hope you have a good answer for that.

There is no documentation for being negligent. Don't try to lie and cover it up it will put you in more trouble. All the best!
