Pavan 1001
Accidentally my employer filed two diff h1b’s for me for cap 2020 from the same company on two different clients, one got approved(Currently working in same client) and other one is withdrawn as soon as the first one got approved. But few days back I got “Intent to Revoke” notice from USCIS for filing Multiple H1B petitions from same company for the same employee. They have given 30 days to respond with an explanation why my employer has to do multiple petitions. Even if my employer respond to that i am not sure if they are gonna satisfy with the reason. Please suggest if there is any way to get safe from this revoke, like transfer of employer or amendment with new client or any other way that will overwrite this "Intent to revoke" notice from USCIS. JoeF
It is not allowed to file multiple H1 for the same employee. The current one will get revoked, and you will have to leave the country. A transfer is not possible since the H1 was approved in error and will be revoked for fraud. Next time find a better employer, not one who breaks the laws. Edited November 25, 2019 by JoeF Quote Link to comment
User099
This should be a good lesson for those who might want to enter this years lottery. It looks like just a $10 fee to enter the lottery is a trap for people who will be submitting multiple applications. Quote Link to comment
gopalakrishnach
BY MISTAKE... there is no mistake at all. This is classic example of breaking laws and later LAW biting you. This must be good lesson. Employers greedines will cost employers life and carrer. You H1B will be revoked no matter what explanation you give.
