Sam3017
Please help me with the next steps so that I can continue working in US considering the below situation: --> I have valid I-94 until August 2022 (approved petition - I797) but resigned 1 month ago from Employer A. --> Employer B filed H1B transfer about a month ago and I started working for Employer B. --> Got RFE for the transfer and the employer submitted the RFE documents last week. --> I got denial today(as per the online status) for the H1B transfer from employer B. Thanks in advance. Quote Link to comment
User099
Talk to an attorney ASAP. You are in the 60 day window of loosing job with Emp A and you have a I94, these might work in favor of you to get an extension. Quote Link to comment
gopalakrishnach
but resigned 1 month ago from Employer A - your 60 days period start the day you resigned Emp A. Find new employer and get approved before 60 days... This is not a legal advise just my personal opinion.... Edited November 21, 2019 by gopalakrishnach Quote Link to comment
Sam3017
Thanks for your response. My attorney got the denial notice but is not ready to share the denial letter with me. They are saying that it has nothing to do with me or my qualifications and they cannot refile for the same client. I can continue with the same client if some other employer files H1 for me (as per my client manager). Now the problem is that the new employer is asking for the denial letter and saying that they are ready to file if I can provide them with the denial letter. Is there any way to get the denial letter from USCIS? Quote Link to comment
