My current visa (H1B) expired on Oct 07,2019 and submitted an H1B extension application on Oct 03 under standard processing and received the receipt notice on Oct 20. My current SOW states end date as DEC 31,2019. And based on current processing time with Nebraska (My Service center) it is estimated to take 4 months average to give decision, which means I would hear back from USCIS around FEB 2020. My question is since the SOW date would fall in the past date (Dec 31,2019) by the time USCIS process my application, will I get a RFE or Denial based on this reason? Or Should I make this as premium processing ASAP to get decision before DEC 31? Please give me an advice. Thanks in advance! Better premium processing and you might get till DEC 31 and you can apply for new extension as per below.
