H4 Stamping without I539 Approval, H1B Approved

Hi,

My H1B visa is approved but my wife's H4 is still showing 'Fingerprint Review Completed'. Stamped Visa on the passport has already expired.

She needs to travel to India so can she get her H4 stamping done based on my I797 approval copy. I will not be travelling with her.

- Consulate will not ask for her I539 approval copy?

- What all documents she needs to carry with her for stamping.

Yes, she can get stamping with your I797 approval copy. All the usual H4 visa documents, better carry I539 receipt too.

All the regular H-4 docs. Make sure she carries the I-539 receipt. That shows that she filed extension and waiting on approval. Just in case if they ask.
