I had a valid H1B visa (stamped and approved till 09/11/2020) and a valid I-94(valid till 09/01/2020). My employer moved location early 2019 and our attorney insisted on filing an amendment with Consular processing. We went ahead and filed an amendment along with extension request. Now I have the petition approved and with validity dates from 10/16/2019 to 10/15/2022. But this time I have a I-797B. My understanding is that I-797B does not come with I-94 section and I would have to travel back to India get my visa stamped and re-enter US to activate my I-94. Is my understanding correct? Can I stay in US until the date in my current I-94(09/01/2020) before I make my travel plans? Or should I travel immediately? If yes, how soon would I have to travel? Is my current I-94 which has a date of 09/01/2020 no longer valid? In that case, the start date in the new I-797B is 10/16/2020. Does it mean my stay in US at the moment is illegal?
