h1bquestions2019 Posted November 12, 2019 Report Share Posted November 12, 2019 (edited) Hi All, My H1b was expiring on Aug-30-2019, So we filed an extension on June-14-2019. Then we converted to premium on Sep-26-2019. On Oct-7-2019 got an RFE. We replied to RFE and extension got approve on Nov-11-2019 till Nov-22-2019 (11 days only). 1) is there chance of typo in dates ? 2) what are the option I have ? 3) How long I can stay in the country file another extension ? User099 Posted November 13, 2019 Report Share Posted November 13, 2019 1. I would have called it a typo till 2016. But in the current administration its difficult to say anything. 2. File for an other extension ASAP. You should be able to use the same LCA as before and save LCA processing time. 3. You can stay till your I94 is valid. Do you have a project beyond Nov 22nd? My employer says, there might be a typo so we have requested to USCIS and waiting for an I797 copy. My I-94 is already expire on 09/01/2019, so do I have to leave the country before Nov-22-2019 ? Can I use grace period in that case and file new extension ASAP ? Quote Link to comment

You need to apply for extension ASAP. Coming to why 11 days there are lot of things like passport expiry, SOW and so on. Quote Link to comment
h1bquestions2019 Posted November 14, 2019 Author Report Share Posted November 14, 2019 We have not received I797 copy yet, also my employer has hope for typographic error. we have requested for the same and waiting for an correction in updated copy. If Nov-22-2019 is valid date, He says we can file a new extension with request that we didn't get enough time to file new extension because we were waiting for an I797 correction. I am guessing this is what your attorney told your employer and not your employers assumption. Getting an second opinion with an other attorney might be a good option. Quote Link to comment

My great employer didn't see the date in the SOW. It was Nov-22 so obviously they extend till that date. fortunately, we are able to file new extension quickly.
