What are my options? 1. can I transfer my H1 to the new employer immediately? 2. do I need to have the payroll run on the employer where I filled H1? 3. If I revoke the H1 will it go back to my previous status (i.e. stem OPT)? 4. is there any grace period for unemployment on H1? Please help me. Thanks. Quote Link to comment

User099 Posted November 6, 2019 Report Share Posted November 6, 2019 If your employer has not revoked your H1 and your Sevis is canceled, you are on H1 currently. If you are not working for the employer, you might be out of status. Talk to an attorney to make sure everything is good before its too late. Quote Link to comment

The employer is required BY LAW to inform USCIS. If he doesn't do that he would have to pay you. No sane employer would pay somebody who doesn't even work there.
