Sharmi Posted October 23, 2019 Report Share Posted October 23, 2019 I am on H1 B with my dependents on H4. All of our I-94 expired on May 2019. Employer A applied for H1 extension and H4 extension on Feb 2019. I moved to Employer B and applied for H1 transfer on August 19th 2019 (Attorney from Employer B said, H4 transfer is not required when they applied for my H1 transfer as it is not employer specific. However , they sent a note to USCIS to link my H1 transfer with H4 petition, for which there is no proof though ) H1 got approved and no status change for H4 petitions Employer A withdrew my H1 H4 got RFE on Oct 9th 2019 and no status change on my H1 transfer with employer B I don’t know what are the RFE details , which would be sent to my old employer now. Will the RFE details be sent to my old employer only or to the Attorney of new employer as they had sent G-28 forms to link the H4 petition with my H1 transfer. Can I convert my transfer to Premium so there won’t be any issue for my dependents? Quote Link to comment

If you H1 with Employer B is already approved, what do you want to convert to premium? There is no premium for I539 (H4 Petitions). If I have to guess, the RFE might be to show that you have an approved I797 (H1) to extend your dependents H4. Quote Link to comment
