maverick_and_goose
I am working for company A as a Software Engineer. My i-140 has been approved and 180 days have passed since i-140 approval. Can I change employer and join company B as a "IT-Manager" OR "IT-Project Manager" OR "Information Systems Manager" while keeping the same priority date from my current i-140? I understand that company B has to file new labor and i-140, but does change of title and duties affect the ability to carry forward the priority date from the old i-140? What is the criteria for retaining the old priority date? Does it depend on SOC code? Any help is appreciated! Thanks in advance! Edited September 27, 2019 by maverick_and_goose Quote Link to comment
pontevecchio
Once approved PD retention has always been possible in the absence of proven fraud. The new job can be in any classification. In your case, since the I-140 has been approved for more than 6 months, you will get further H1 extensions based on this approved I-140 till the PD is current. Quote Link to comment
