H1B to H4 to H1B COS

Hi,

I am currently on H4 status.

Previously my H1B was approved to start working from Oct 1st 2013 while I was in India. I got an job opportunity in November 2014 to travel usa and start working on H1B. After an year (2015 August) I moved to H4 status. I have three questions to move my status to H1B if I had a job opportunity and sponsoring employer.

Q1: Can I apply for cap extempt H1b using previous H1b petetion?

Q2: if the answer for above question is yes then How much time still left over for me to actually use my previous H1b  to reapply again (Cap exempt) ?

Q3: Is Premium processing currently available for H4 to H1b petetions?

1) I guess any employer can use your old H1B and apply in non-cap.

2) Total you will have 3 years on H1B. You might almost have 1 year. I may be wrong.

3) I guess yes.

Are there any changes with regards to cos from H4 to H1B, if we have a past H1B from a employer. What would be challenges for COS from H4 to H1B if the employer wishing to sponser.
