H1B stamping with Old I-797 and New I -797

Hello,

I have a quick question about H1B stamping and below are my details.

1. I have a valid I-797 till January 10th 2020 (no stamping on passport) (old 797)
2. I have applied for my extension and was approved as well. My extension starts from 30th December 2019 and is valid till 29th December 2022 (new 797).

Question 1: On which petition am I supposed to get stamped?
Question 2: If extension (new 797), can I go for stamping in the first week of November?
Question 3: If approved, can I enter the country before 30th of December 2019 (somewhere by the end of November)?

Any help is appreciated. Thanks!

You need to provide your new I-797 USCIS tracking number on DS-160. However, when you go for your interview, you need to carry both Old and New I-797.

Your visa stamp will have both Petition numbers. I had a similar situation in 2014 and had no issues at U.S. Consulate Mumbai. Your stamp will read:

 

Annotation:
Petition#EAC123456789 PED: 29Dec2019
Not valid for travel until  20 Dec 2019 [10 days before your new I-797 kicks in] -> this line applies to the new Petition approved
PN: CompanyName
Petition#EAC987654321 PED: 29Dec2022
