BEN SHERMAN
Hello, Company A currently holds my H1b and I recently got a job with Company B. However, the company B wants me to join upon receipt. I agreed and the company B initiated the H1b transfer After a week after joining company B, I got an exciting offer from Company C. I accepted Company C offer and initiated the H1B transfer as well. So there are 2 H1b transfer petitions currently processing. Question - If the H1B visa transfer to company C was approved before Company B's petition for transfer. Do I have to leave my current job at company B immediately? Question - I really enjoy my work at current company B. Can I plan on staying at company B and ask Company C to withdraw the visa even after approval? Thanks for all the help! Quote Link to comment
gopalakrishnach
1) If you want to join C at one point of time you need to give B notice and then join C. You cannot get C hanging forever. 2) Yes, you can say to C that you are not joining them and by law they must inform USCIS that you no longer work for them and get h1B revoked. Quote Link to comment
