H1 extension for 7th year with Client letter and NO SOW

Hi all,

My company (an MNC) is planning for H1B extension with approved I-140. My current H1B visa is valid till Dec 15th 2019. Current project SOW is valid till 31Dec2019. New SOW will be received only after november 2019. So for this extension, I am proceeding with Client letter.

In the client letter, my client has mentioned

A) Our current contract with ABC (employer) is valid through 31Dec2019.

B) Under normal business process, we generally finalize project extensions a month before expiry.

C) We expect this project to get extended to 31Dec2020 and possibly beyond.

 

With the points A,B,C in the client letter, I have few questions (This is my first time extension with approved I140.)

1)My company legal team is refusing to file extension with the client letter with point A. They say that there is a chance of getting visa extension till 31Dec2019 (which is just a 2 weeks from my current visa expiry date). 

They ask to remove point A which client is not willing to do.

Rather he can give me a client letter without any of A,B,C.

2) What are the chances of my Visa approval with points A,B,C as it is in the client letter (In case we(my business head) convince our company legal team). Will I get visa extension for

a) 2 weeks - current contract end date

or

b) for 1 year - as mentioned by client in point C

 

3) What are chances of approval if points A,B,C are all removed? 

Having said this is my first time extension with I140, will I get a 3 year extension by any chance? I am assuming without any end date in client letter, will they refer to LCA which has 31Dec2022 as end date (3 years from current contract end date).

Hi, 
I got an RFE questionnaire which had speciality occupation details and also cluent documentation section. 

I have initially filed in premium with end client letter with dec 2019 as end date with possible extensions of the project. I didnot provide SOW as it says Dec 2019 as end of current contract. 

RFE is as below: 

Employer-Employee Relationship/Right to Control in the U.S./Availability of Specialty Occupation Work 

Client Documentation: 
· Current SOW or MSA (signed by both parties), if not already provided 
· Documentary evidence showing that the end-client requires the beneficiary’s services 
· Documentary evidence regarding the end-client’s requirements (if any) for the position, for all of the client facilities where the beneficiary will be employed. 

Can someone please let me know what a documentary evidence is. Because I already provided client letter.
