L2 I94 expiring due to old expired passport while H1B COS is pending - how to extend I94?

Hi,

I am currently on L2 and pending approval for H1B COS for 2020.

My  passport which was used for H1B application was about to expire on Oct 8th 2019 and I got it renewed. Now with my new passport - I want to extend my I94 which was also until Oct 8th 2019

If H1B approval comes before Oct - I am good.

If Not, my I94 will expire and I will considered not legal.

 

If I travel out to extend my I94 with new passport - will it affect my H1B COS approval?

If I file I539 for extending I94 without going outside - will it affect my H1B COS approval?
