Vijay Kumar Teki Posted July 30, 2019 Report Posted July 30, 2019 HI I was in the US for 6 years. When my Labour and I140 were denied, my company has processed my work permit to canada. My h1B expiry date was 12th July . I moved out to canada on 23rd. My question Do I need a visit visa to enter US for some pending tasks. Please suggest
JoeF Posted July 30, 2019 Report Posted July 30, 2019 You would need a visitor visa to enter the US, but with an I-140 having been filed (even if it is denied) you have shown immigration intent, which makes it very hard to get a visitor visa. And of course, you can not work with a visitor visa.
pontevecchio Posted August 3, 2019 Report Posted August 3, 2019 I would expect that if you are totally upfront about the I-140 and denial , they would give you a visa albeit for a short duration initially.
