ARUN06 Posted July 18, 2019 Report Posted July 18, 2019 Hello Team, My H1b visa expired on 15th Dec 2018 and I got my 1st H1b extension up to 10/22/2019. No visa stamped and I am in USA with I-94. I applied for a new extension and I got the new I797 valid from 10/23/2019 to Oct 2021. I am planning to go to visa stamping in the month of August 2019 and based on the approval I am planning to return to USA on end of August 2019. Kindly advise what will be my visa start date in my passport. Is it 10/23/2019 or based on my old I1797, will I get the old start date?? If I get the visa start date as 10/23/2019, can I still travel to USA with my old & new I797. Whether US Immigration will accept this? Kindly advise.
02112018 Posted July 21, 2019 Report Posted July 21, 2019 10/23/2019 will be visa start date on passport and if you travel before that you got to wait until 10/23/2019 to return if there is no previous visa stamped on passport for 1st H1b extension up to 10/22/2019.
