Manmohan Posted July 18, 2019 Report Posted July 18, 2019 Hi folks - I need some information, appreciate early response. I was working with XXX company in US on H1B for XXX client, I resigned and came back to India due to personal reasons. After coming back to India, I joined XXX company with new US client. Its been 2 year now I have been working in India. Now there is client requirement where I need to travel back to US, but my I-797 duration as well as Visa is expired. Also, my client is not providing client letter due to organizational policies. So, below clarifications I am seeking: 1. Can my existing company can file my H1B transfer & extension under premium processing in India without client letter. Is there are any challenges ? 2. Once my H1B is transferred & extended, once I get my new I-797 I will go for Visa stamping. Is there are any challenges there ? Looking forward. Thanks.
gopalakrishnach Posted July 19, 2019 Report Posted July 19, 2019 I am not an expert and this are my personal feelings. Since you said " my I-797 duration as well as Visa is expired " I feel you need to enter lottery.

Yes considering you still have time left from your initial period of 6yrs on this H1B, if not then you need go through the fresh H1B filings starts every year April 1st. On a second note cannot guarantee but its difficult to sail through USCIS without client letter while you are working for a client. 2. Once my H1B is transferred & extended, once I get my new I-797 I will go for Visa stamping. Is there are any challenges there ? Looking forward. No problem at all if everything is clean and clear on your profile and your employer profile. Thanks.
