BG2019 Posted July 7, 2019 Report Share Posted July 7, 2019 Hi, I am currently into my final semester of MBA with full time job on H1B with approved I140. I was recently RIFed from the company. I wanted to finish the college without any illegal stay. what are my options? Can I file F1 transfer with approved I140? If I file F1 can continue my study while it is in approval process? JoeF Posted July 8, 2019 Report Share Posted July 8, 2019 (edited) The F1 doesn't allow immigration intent, but the I-140 shows that you have immigration intent. So, it is impossible to change to F1. care_candidate Posted July 8, 2019 Report Share Posted July 8, 2019 You can continue your MBA as long as you have a valid H1b. If that is getting cancelled for any reason before MBA completion, you need either F1 (Full time) or J-1 visa. Each has lot of strings attached to it and would require formal application. If you don't have lot of time, contact school immigration officer immediately on your options. You may have to get new visa stamped but that is not a big hurdle in many genuine cases.
