adspace0611 Posted June 12, 2019 Report Posted June 12, 2019 Hi, I need your expertise to move forward with my case. my, I 94 expires on 01/2020. my vendor wanted to hire me as a full time, so they had filed H1b transfer on 01/2018. unfortunately because of typo on letters, uscis rejected my h1b transfer on 09/2018. based on the information mentioned in the rejection letter, my current employer filed H1b transfer again with updated letters on 09/2018. because of premium processing not available at that time, we filed it again under regular processing. we upgraded my case to premium on 02/2019 and got RFE about specialty occupation. RFE needs to be answered by 06/27/2019. in the meantime I got full-time offer from my client. they will start my H1b transfer soon. now i am in situation where to tell the client to hold on my transfer until i get an approval from current employer. since i am working on their payroll for almost 18 months. or shall i go ahead ask my new employer to initiate the transfer ASAP.
gopalakrishnach Posted June 13, 2019 Report Posted June 13, 2019 I feel new employer can start H1B transfer after that your decision. My opinion not a legal advice.
