H4 221(g)

Here is my wife visa experience on her h4 and 221(g).  I was terrified that she received a 221(g). But thankfully she received her visa 5 days later. But I thought this is something that we should share here.

My wife went for a visa interview on May 6th and in the end, she came out with a yellow 221(g).

Here is my background. I have been working fulltime for a top company throughout my H1 (2010) with I-140 approved and never had any visa or stamping issues. My wife was on F1 and moved to H4 in the past few months. We chose to go to a consulate outside India as we are holidaying there. I went to the same consulate twice before and did not have any issues.

Here was the list of questions:

1. Did you come here for a h1-b visa?

No. H4.

2. Looks like you were on a different visa before?

Yes. I was on a F1

3. When did you finish your M.S?

2015.

4. Did you have an OPT after that?

Yes.

5. For long?

2016 and I got an extension till 2018 July.

6. Do you have your OPT card?

No. I did not bring it.

7. What visa status have you been from July 2018 till now. 

I switched to H4 in July 2018

8. Hmm... I cannot verify this on my system. My system is down.

9. Show me your marriage cert.

presented.

10. What does your husband do?

Explains the job duties.

11. What is the name of the company and what does the company do?

Explains that too.

12. Now the officer handed her the yellow 221(g) and told her that it is going to take more time to process.

How long would this take?

13. We will process it soon but does not commit and asked if she wanted her passport back.

My wife declined.

But after 5 days we see that the visa is issued.
