dhivaks Posted May 7, 2019 Report Posted May 7, 2019 Currently i am having valid h4 EAD and working with employer A in C2C mode and my end client is B. Due to uncertainty with EAD i have applied for h1b this year quota (2020) through my employer A and its picked in the lottery. Meanwhile my end client B is ready to offer me full time employment and the joining date is 2 months away. with this scenario, please guide me 1. My employer A is a preferred vendor for my client B so recruiting employee in contract mode and converting them into FTE is usual thing. but in my case I am going to be converted to FTE when my h1b is in progress. so If I accept this FTE offer with end client B will my employer A revoke my H1B petition (which is picked in the lottery)? 2. What are the possible case I could get my h1b and join my FTE offer as well, Can I ask my current employer to convert my h1b petition to premium and so my h1b approval/rfe happen in another 15 days. so i can be sure on whether to accept the FTE offer or no before the given 2 month time frame... or can I request my employer A to hold my petition until October and transfer to employer B once its approved? and continue working with EAD until then.. I got this FTE as well as H1b lottery after 3 yrs of hard work and effort and after so many attempts. so I do not want to miss them.. would like to plan it better.. please any advice would be appreciable. adshah84 Posted May 8, 2019 Report Posted May 8, 2019 Here what i would do if i am in your situations. 1) Convert H1b in PP 2) State clearly to client who is offering full time position that you can not join them before your H1b kicks in that is 1st Oct. You will need at least one paystub from your original petitioner to transfer your H1b 3) Once you have one paystub on your H1b initiate H1b transfer in PP and once approved join as FTE.
