cyberlord Posted May 6, 2019 Report Posted May 6, 2019 Hello All, I received my H1-B in October 2013. Traveled to USA in December 2013 and stayed/worked there till December 2015 (2 years). I returned to India due to personal reasons. I would like to go back to USA now. I read about the possibility of filing H1-B cap exempt. Is there any time frame by which I'll have to file cap exempt? I read that the cap exempt can be filed only within 6 years from the start date of the original petition. Is this true? If this is true, do I have time only till October 2019 to get my H1-B filed in cap exempt? Please let me know. Regards
JoeF Posted May 6, 2019 Report Posted May 6, 2019 The 6 years is from the date you last were in H1 status. And even then, lots of people have been able to get a cap-exempt H1 after that timeframe.
