keer Posted May 1, 2019 Report Posted May 1, 2019 Can I continue working with my H4 EAD extension receipt number while it is still pending with USCIS and my current H4 EAD expires next week. I heard some new rule that we can work up to 180 days even after expiry of our current EAD in case if we already filed for extension. Does this rule really apply to h4 EAD too? Quote
xTDx Posted May 1, 2019 Report Posted May 1, 2019 Those rules do not apply to H4 EAD. You must stop working on last day of your H4 EAD and can resume work once renewed card is in HAND. Not with an approval notice, not with an email confirmation, only when you have the card in hand and the card dates are valid. Quote
adshah84 Posted May 1, 2019 Report Posted May 1, 2019 No you can not. You have to stop working. 180 days rule does not apply for H4 EAD. Quote

You cannot work based on receipt for your C26 category. Eligibility category codes for a 180-day automatic extension are A03, A05, A07, A08, A10, C08, C09, C10, C16, C20, C22, C24, C31 and A12 or C19. Below is the official link that shows which categories are eligible for 180 day EAD extension. https://www.uscis.gov/i-9-central/42-automatic-extensions-employment-authorization-documents-eads-certain-circumstances Quote
g_someshwar Posted December 4, 2020 Report Posted December 4, 2020 If a person works without noticing above conditions, what he supposed to do? Need to inform USCIS or IRS or any other...? Quote
