My LCA and H1B was filed and got approved for the same job title/responsibilities and location 2 years back in april 2017 and is valid until march 2020. I am transferring from LA to San Jose branch for the same company with same job title/responsibilities. Do I need to file an amendment ? I read from wiki that if the employer doesn't change and working for the same company no need to file the amendment. can you please let me know whether or not to file an amendment in my situation. When to not File an H-1B Amendment When an H-1B Employer relocates from one to another branch within the same company. When the petitioner company changes the name. The petitioner may report the change of the company name while filing the extension of stay for the candidate.

xTDx Posted May 1, 2019 Report Posted May 1, 2019 LCA work location is changing. Your employer should file a new LCA and file a h1b amendment application. Each area/MSA/city has a specific wage level applicable to specific jobs. You should ask your employers attorneys these questions. They know about the position,wage and your case details more than us.
