tmeng Posted April 19, 2019 Report Posted April 19, 2019 I am currently working using cap-exempt H1B. My husband's I-40 just got approved and since H4 EAD rules have not been revoked yet, I'm planning to change my visa type to H4 so that I can go to private sectors. My questions are: 1. after converting to H4 and while waiting for EAD to arrive, can I still work? 2. How long does it normally take to receive EAD card after the conversion application being submitted 3. If h4 EAD get revoked, does my employer need to start a new h1b application for me or is it okay for them to just extend my current h1b? Thank you for your thoughts!!!

You cannot work once your COS is approved to H-4. You need to wait until your H-4 EAD is approved. 2. You can check timelines on USCIS website. Depends on the state you live in. 3. He can just apply for COS again back to H-1.
