Software Developer to Manager H1B complications

Hi, 

I'm currently a Software developer since 3.5 years. I have BE from India and MS from US. I'm on H1b visa. Now that I want to go into management role Product Manager. I have 2 questions here. 

1. To go into Product management role - Say i get the job - Do I need a MBA for the H1b approval (Speciality occupation) ? 

2. My Perm for Green card is going on with my current company as software developer. Lets say I go to Product manager role, and to do the Perm and I140 in that role can the priority date i received as software developer be retained?

simple answer- if your JD-SOC and education background does not fit the specialty occupation criteria, there are high chances of rejection.

present this situation to company attorney, they can see through this easily.
