ns123 Posted March 25, 2019 Report Posted March 25, 2019 I am currently on H1B (expires in 2021) but plan to go back to school Fall 2019 for PhD. The school advised against going "Change of Status" route as it takes several months. I think that means I will have to apply from outside USA and get F1 stamp on my passport. I was wondering if it would be a problem to get it done from Canada instead of India (my home country) and if there are processing delays, can I re-enter USA on my H1B because technically the H1B doesn't expire until the F1 gets approved. I have a job offer till Jun 2019 with an option to extend if I join to school later than July 2019 (because of VISA or other issues). I don't know if this is something complicated enough to hire an attorney for?
