COE with valid H1 and premium processing

Hi,

I have H1b valid till June 2020 with current employer. I have got a job with another Top 50 company.

1) Can I join new company with only receipt? Is premium processing open for this category

2) If the COE is rejected can I still have the first H1b approval valid provided I do not communicate to current employer.

3) will the uscis automatically withdraws my valid H1b if COE gets rejected.

Once you leave the current Employer, they have to inform USCIS and revoke your H1b.  You have to communicate your change of employment to them. That's the law!

1) Can I join new company with only receipt? Is premium processing open for this category - You can join. As of now all h1B petitions applied before Dec 23 2018 are eligible for premium processing.

2) If the COE is rejected can I still have the first H1b approval valid provided I do not communicate to current employer. - If you current employer and you are on god gorunds and they didnot revoke your valid H1B  you are good. Now ethical questions are up to you...

3) will the uscis automatically withdraws my valid H1b if COE gets rejected. - I am not sure but I guess they will not. Your current employer must put petition to revoke your H1B.
