Job duties including percentages while sending initial h1 docs

Hi everyone,

My employer filed my h1 petition last year and it got denied after getting an RFE on speciality occupation. I did my masters in computer science and my job is related to my education, but my employer was failed to submit proper documents. 

now they are filing h1 again this year and they want to include percentage of time spending on each job duty to avoid RFE again.

is it ok to include job duties now itself ?? as far as i know we do it when we get a RFE.

is that a dumb thing to submit % of time on each duty now itself?? 

Now i don't have time to find new employer, i have to go with this employer only.

If you can't find a good employer, you have no choice but to exit the US; simple as that. Stay away from such a shady excuse of an employer. And you failed to inform us about the university when asked last year.

As far as I know during H1B application we submit resume, job description/duties, time sheets, work done, employer/employee relationship... I donot know what you mean by submit %... if job is developer you will show that you are working as developer... consult expert...

USCIS while questioning the position as a speciality occupation is asking to provide certain number of documents. Sometimes USCIS explicitly ask to provide job functions and percent of time spent on such functions as part of RFE response. USCIS perhaps want to know/document what the employee will work on and want to determine what kind of position it is.  Some law firms are taking preemptive measures to provide such document.

Listen to your employer and their attorneys. And this should not be your job. Your manager should be doing that and sending this info to employers attorneys. You stay out.
