Why do you want people to do the job of thinking about your question and assuming N number of things to give a magical answer so that you can sleep at night ? - Do you have a cap-gap i120 ? - Was H1b filed under FY 2019 cap ? - Why was COS not filed along with H1b ? - If COS was filed why it was denied ? Now doing what you want and assuming your H1b was filed as a COS from F1 to H1b and COS was denied. You should leave USA at the end of your current status expiration plus any grace periods. You can then come back using a valid visa stamp against the approved H1b petition. While being on OPT, you cannot change employers using current approved H1b unless you are working for the approved H1b petitioner under H1b immigration status.

pontevecchio Posted February 23, 2019 Report Posted February 23, 2019 You should go and get the visa and return at the appropriate time and work for a short term for the initial H1 sponsor and then you can look for new employment.
