the1 Posted February 15, 2019 Report Share Posted February 15, 2019 my new employer is requesting to work on H1B receipt(as he is sure petition will be approved later), just wondering can I still keep old H1B petition and give reason to old employer as "sick leave"(say 3-4 months). And if petition with new employer doesn't approve then go back old employer. is it a possible scenario? Link to comment
JoeF Posted February 16, 2019 Report Share Posted February 16, 2019 A fake leave is grounds for being fired for cause. The old employer is required by law to inform USCIS that you no longer work there. That means the old H1 will get revoked. Link to comment
