rasija Posted January 4, 2019 Report Share Posted January 4, 2019 I have worked in US as a licensed pharmacist for 7 years (2008-2016) and I my I-140 has been already approved with the priority date of November 7, 2010. I had to come back to India in June 2016 and I am in India now. My H1B was expired on October 3, 2018. Can I move to consular processing even though I do't have valid H1B? pontevecchio Posted January 6, 2019 Report Share Posted January 6, 2019 You can use CP if the I-140 sponsor will still have the job available to you . H1 status is immaterial. Of course you can return in H1 status if your sponsor will file a H1 for you. Quote Link to comment
