h1bholder199
Hi, My first H1B amendment for the current location in CA was denied in March 2018 . Then I traveled to my previous LCA location in MD and filed one more amendment for the same location in CA. After filing it I traveled back to CA and now continuing my work. Its been nearly 4 months since my employer filed the second amendment and the petition is pending with USCISnow. My I797 and stamping are valid till March 2019. Could you please let me know what will happen if my second amendment is also rejected? Will it lead to the revoking of original H1B status(I797) which is valid till March 2019? (or) Will I have to go back to the same previous LCA location(MD) to file the third amendment for the same location in CA? Thanks. Link to comment
pontevecchio
How do you expect the same amendment to be approved now after being denied once? If you do it again after rejection, your employer will be under scrutiny and all his H1 petitions investigated as it would be an frivolous filing. You do have an H1 petition filed for the MD location. Why is that job gone? Link to comment
