H1 B Transfer RFE-- Can I apply one more H1B Transfer on first H1B which is still active

Hello friends , 

 

Need your valuable advice  ,   I recently Moved from ORG A to ORG B  but received  RFE during  H1 B Transfer to Org B, I already joined ORG B and working from last 1 Month , To Be on safer mode, I am trying for another job , If I get job in ORG C , Can I Transfer H1B to ORG C from ORG A H1A  (H1B visa of ORG A is still active) ,   As My H1 Transfer to ORG B is still in process , Can I go for Transfer from ORG A to ORG C and also do I need to inform ORG C about this situation about H! B Transfer to ORG B under process. 

 

Please suggest , Your valuable suggestions matter a lot to me.

"transfer" in this context means a new H1 employer filing and getting a H1 petition non cap approved for you.

Yes You can. Informing Org B is completely your choice. Dont have to though.

You might face similar situation when Org C apply for your H1.  it is better to wait till you get H1 approval for Org C, and continue working for Org A till then.

To avoid uncertainty have C or D etc. file and get a H1 petition non cap approved in PP if still possible and return with a visa on approval. This avoids months of uncertainty specially under the current situation.
