JoeF Posted June 11, 2018 Report Share Posted June 11, 2018 When the Priority Date is current, she can file an I-485 as your dependent, based on your I-140. She won't get her own I-140 unless her employer initiates a GC process for her and files an I-140 for her. Link to comment

If her H1 expires, she can continue to stay on H4 as long as your H1 is valid. And if the H4 EAD still exists then, she can work with that. Alternatively, she can of course go for her own GC process with PERM/I-140 from her employer. Link to comment
