skmandava Posted May 10, 2018 Report Share Posted May 10, 2018 Hi, Right now I am working with an employer A and my green card process is with him, I have my I140 approved around 2 years back. My wife is on H4 EAD. I am in the 5th year of my H1B which is valid until Jan 10th 2019. Is it possible for me to change my employer at this point? as I have only 8 months left on H1B . If I transfer my green card process to a new employer, he should get my I140 approved before Jan 10th 2019 and then file for my H1B extension before Jan 10th 2019. Is this practically possible as the time is very short? Also, Can my wife continue to stay on her H4 EAD during this transfer process? Link to comment
pontevecchio Posted May 11, 2018 Report Share Posted May 11, 2018 Any new employer can apply for and get a H1 petition approved for three years since your I-140 has been approved for more than 6 months and you will get further extensions till the PD is current. January 10, 2019 has no meaning to you. Link to comment
