saakshi85
Hi, Currently I am on OPT and have received a job offer from a government/city office. I wanted to know if they are cap-exempt when they file H1b. Is there any website where I can check it? Also what are my future prospects, as to if I change my job to cap-exempt / non-cap exempt jobs? For non-cap exempt jobs will I have to go through H1 lottery; how can a company file for my visa in April without me joining them and then wait for several months (October)to hire me? Thank you Link to comment
NotAnAttorney
If this employer is cap exempt, and if he files for H-1B, you can then only move to cap-exempt petitions until some employer files for your H1B for cap quota, after which you can switch to cap companies from cap-exempt companies. Durham
1. Most likely not exempt. Non-profits, universities are typically exempt. 2. Yes, if you move from exempt to non-exempt, you will be subject to cap and lottery, if applicable. Link to comment
