The H1 Petition got approved for only one year, since 6 years of visa(5 years L1+1 year H1) got max out, I moved out of the Country. Now my question is that can I utilize the unused 5 years of H1 without going for a fresh CAP. Please clarify Thanks, Ramesh Quote Link to comment

JoeF Posted March 20, 2018 Report Share Posted March 20, 2018 No. There is no 5 unused years. The H1 can only be for one year. The clock only resets if you are outside the US for at least one year and then a new H1 in the quota is FILED. Quote Link to comment
