Yogiwaiting Posted March 20, 2018 Report Share Posted March 20, 2018 My H1b extension was denied (Level 1 )and my employer filled a new petition with new LCA in Premium processing. Currently I am in India. My employer has informed me that they received a RFE for the new petition asking for SOW/MSA and org structure. I am currently working for the same client I used to work in US. However the current SOW is for a offshore resource. Also the SOW is until May 2018 with chances to extend. Question- 1. Can we provide the offshore SOW to USCIS stating the situation about I working from offshore currently or do we need a new SOW from client. The job duties remain the same whether i work from onsite of offshore. 2. Since the SOW is remained just for few months, will it impact my extension chances? The client is doing just 3-5 months SOW's in the past. 3. Does the SOW duration matter for extension approval or denial? 4. Anything i need to let my employer know in such scenarios?? Link to comment
